This Agreement is between you ("Customer" or "you") and Low Cost Fiber ("we," "us," or "our") and governs your use of our internet services. By using our services, you agree to be bound by these Terms and Conditions.
Low Cost Fiber provides residential fiber-optic internet service at the speeds and prices indicated in your service plan. We offer:
Service availability is subject to technical and geographical limitations. We will verify service availability at your address before confirming your order. Installation is subject to a site survey and technical feasibility assessment.
Monthly Charges: You agree to pay the monthly service fee for your selected plan. Payment is due on the same day each month.
Price Lock Guarantee: Your monthly rate is guaranteed to remain the same for 3 years from your service activation date, unless you change your service plan.
Payment Methods: We accept major credit cards, debit cards, and automated bank transfers (ACH). Automatic payment is required for continued service.
Late Payments: A late fee of $10 may be charged if payment is not received within 10 days of the due date. Service may be suspended if payment is not received within 30 days.
Taxes and Fees: Your bill may include applicable taxes, regulatory fees, and surcharges as required by law.
Professional installation is included with your service at no additional charge. You must:
If you cancel or reschedule an installation appointment with less than 24 hours notice, a $50 fee may apply.
Our Equipment: We provide necessary equipment including a modem/router at no additional monthly cost. All equipment remains our property and must be returned upon service termination.
Equipment Damage: You are responsible for any loss or damage to our equipment beyond normal wear and tear. Replacement fees may apply.
Return of Equipment: Upon termination of service, you must return all equipment within 30 days. Failure to return equipment may result in a charge of up to $200 per device.
Advertised speeds are maximum speeds. Actual speeds may vary based on network conditions, equipment, network traffic, customer location, and other factors. We do not guarantee specific speeds at all times. Wired connections generally provide better performance than wireless connections.
No Contract: This is a month-to-month service agreement with no long-term contract required.
Cancellation by Customer: You may cancel service at any time without penalty by contacting us. You are responsible for charges through the end of your current billing cycle. Equipment must be returned within 30 days of cancellation.
Suspension or Termination by Us: We may suspend or terminate your service for non-payment, violation of these Terms, violation of our Acceptable Use Policy, or fraud.
Gift Cards: Amazon gift cards are available with select plans and are provided after 90 days of active service. If service is cancelled before 90 days, you are not eligible for the gift card. Gift cards are non-transferable and subject to Amazon's terms and conditions.
Promotional Terms: All promotional offers are subject to terms and conditions, availability, and may be modified or discontinued at any time. Promotions are only available to new customers unless otherwise specified.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
Our total liability shall not exceed the amount you paid for service in the 3 months prior to the event giving rise to the claim.
You agree to indemnify and hold harmless Low Cost Fiber and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the service, violation of these Terms, or violation of any rights of another party.
Informal Resolution: If you have a dispute, please contact our customer service team first to attempt to resolve the issue informally.
Arbitration: Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.
Governing Law: These Terms shall be governed by the laws of the state in which service is provided, without regard to conflict of law principles.
We may modify these Terms at any time. We will provide notice of material changes by email or through our website at least 30 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
